Read this first. Bryndis is a safety companion. It is not a replacement for emergency services. In a life-threatening emergency, always call 000 (or your local equivalent) first. Bryndis depends on your phone, your battery, mobile network coverage, and third-party services to deliver alerts — none of which can be guaranteed.

1. Who these terms apply to

These Terms of Service ("Terms") are a binding agreement between you and Adam Johnson, trading as BRYNDIS (a business name registered with the Australian Securities and Investments Commission on 12 May 2026), Australian Business Number 73 260 832 724, based in Adelaide, South Australia ("Bryndis," "we," "us," "our").

By creating an account, downloading the app, or using bryndis.com.au, you accept these Terms. If you do not accept them, do not use the service.

2. What Bryndis is, and isn't

Bryndis is a mobile application that allows you to:

  • Trigger an alert ("SOS") to a list of trusted contacts you have chosen.
  • Set a check-in timer that escalates to your trusted contacts if you fail to confirm you are safe.
  • Drop a location pin and navigate back using an augmented-reality compass.
  • Optionally subscribe to additional modules (currently Date Buddy and Rideshare Tracker).

Bryndis is not:

  • An emergency dispatch service.
  • A monitored security service or alarm-receiving centre.
  • A medical, mental health, or domestic violence support service.
  • A substitute for calling 000 (or your local emergency number).

3. Eligibility

You must be at least 16 years old to use Bryndis. If you are between 16 and 18, you confirm that a parent or guardian is aware of your use of the service.

You must provide accurate information when creating your account, including a valid Australian mobile phone number.

4. Your account

You are responsible for keeping your account credentials secure. Notify us at support@bryndis.com.au if you suspect unauthorised access.

One account per person. You may not share your account with anyone else.

You may delete your account at any time from inside the app. See our Privacy Policy for what happens to your data after deletion.

5. Trusted contacts and SMS

By adding a trusted contact and providing their phone number, you confirm that:

  • You have a reasonable basis to believe that person would consent to being added as a trusted contact.
  • You will inform them that they have been added (we will also send them a one-time SMS).
  • You will remove them promptly if they ask you to.

SMS messages sent by Bryndis fall into two categories:

  • Transactional safety messages — verification codes, safety event alerts, missed-check-in notifications. These are required to deliver the service and are not marketing.
  • Optional service updates — sent only with explicit opt-in. You may unsubscribe at any time as required by the Spam Act 2003 (Cth).

6. Subscriptions and payment

Bryndis's core safety features (SOS, trusted contacts, check-in timer, find-your-car) are free of charge.

Optional modules (Date Buddy, Rideshare Tracker) are available via an auto-renewing subscription, currently A$4.99 per month or A$39.99 per year. All payments are processed by Apple under their iOS billing terms.

Your subscription automatically renews unless you cancel at least 24 hours before the end of the current period. Cancellation is managed in your Apple ID Subscriptions settings — Bryndis cannot cancel an Apple subscription on your behalf.

7. Refunds and Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the service fixed or resubstituted if it fails to be of acceptable quality and the failure does not amount to a major failure.

Refunds for Apple-billed subscriptions are processed by Apple. To request a refund, use the Apple "Report a Problem" page. We will assist your request where the Australian Consumer Law applies.

8. Acceptable use

You agree not to use Bryndis to:

  • Harass, stalk, threaten, or surveil any person.
  • Add someone as a trusted contact without a reasonable basis to believe they would consent.
  • Trigger false alerts deliberately.
  • Attempt to access another user's account or data.
  • Reverse-engineer, copy, or build a competing service using Bryndis.
  • Do anything illegal under Australian law.

Repeated breach of these obligations may result in suspension or termination of your account without refund.

9. Our content

All software, designs, text, graphics, and trade marks within Bryndis and on bryndis.com.au are owned by us or licensed to us. The name "Bryndis" and the Bryndis logo are our trade marks. You may not use them without our written permission, other than for fair purposes such as press coverage of Bryndis.

You retain ownership of the content you create or store using Bryndis (your trusted contacts list, your safety event history, your account profile). You grant us a limited licence to process that content solely as required to deliver the service to you.

10. No emergency-service guarantee

You accept that Bryndis is a software service that depends on factors outside our control, including:

  • The state of your device, including battery, signal, operating-system version, and permissions.
  • Mobile network coverage and capacity.
  • The Apple Push Notification service.
  • The Twilio SMS network.
  • The Supabase Sydney database service.
  • The willingness and availability of your chosen trusted contacts to respond.

We do not guarantee that any alert will reach any specific recipient at any specific time. Bryndis must not be relied upon as your sole means of obtaining help in an emergency. In an emergency, always call 000 (or the local emergency number) first.

11. Liability

Nothing in these Terms limits or excludes any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be limited or excluded.

Subject to that, to the maximum extent permitted by law:

  • Bryndis is provided on an "as-is" and "as-available" basis.
  • We exclude all warranties and conditions not expressly set out in these Terms.
  • Our total aggregate liability to you in any 12-month period, in connection with the service, is capped at the greater of (a) the amount you paid us for subscriptions during that period or (b) A$100.
  • We are not liable for any indirect, consequential, special, or punitive loss, or any loss of profit, revenue, business, opportunity, goodwill, or data, however arising.

12. Indemnity

You agree to indemnify us against any loss, damage, cost, or expense (including reasonable legal fees) we suffer arising from your breach of these Terms, your unlawful conduct, or your misuse of the service.

13. Termination

You may stop using Bryndis at any time by deleting the app and your account.

We may suspend or terminate your account if you materially breach these Terms, or if we are required to do so by law. Where reasonable, we will give you notice and an opportunity to remedy the breach first.

Provisions of these Terms that by their nature should survive termination (including the disclaimers, liability, indemnity, and dispute clauses) will continue to apply.

14. Disputes and governing law

These Terms are governed by the laws of South Australia and the Commonwealth of Australia. You and we agree to submit to the non-exclusive jurisdiction of the courts of South Australia.

Before commencing any court proceedings, you agree to first contact us at legal@bryndis.com.au to attempt to resolve the matter informally. Nothing in this clause prevents either party from seeking urgent injunctive relief.

15. Changes to these Terms

We may update these Terms from time to time. We will publish updated Terms at this URL and update the "Last updated" date. For material changes — for example, changes to the liability cap, the subscription price, or the scope of the service — we will notify you in the app and by email at least 14 days before the changes take effect. Continued use of Bryndis after the effective date constitutes acceptance of the updated Terms.

One important note. These Terms of Service have been prepared in good faith and reflect our best effort to align with the Australian Consumer Law, the Privacy Act 1988, and the Spam Act 2003. They have not, at the time of publication, been reviewed by a qualified Australian lawyer. A formal legal review is in progress and the Terms will be updated following that review.
